The dictionary definition of jurisprudence – fiqh in Arabic – is understanding, but it must be accurate understanding, as accuracy is what distinguishes jurisprudence from general understanding. Accordingly,
Indeed We sent Our Messengers with Clear Signs, and We sent down with them the Book and the Balance that people may uphold justice.
The Almighty said that He gave mankind the Book and the balance ﴾That people may uphold justice﴿ (Holy Quran 57: 25). Is there any difference between equity and justice?
On studying exegetes’ opinions on the meaning of the balance in the Holy Quran, I found out that there are six meanings associated with the term:
The Prophet ﷺ referenced the balance and its derivatives in many Hadiths. In these Hadiths, the balance refers to scales used for measuring weight, criteria for judgment,
Ibn Taymiyyah, may Allah have mercy on him, interprets the balance as sound analogical deduction, justice, and the thing that is used for measuring weight. He says,
The jurisprudence of the balance is a major, rather than minor, field of jurisprudential knowledge. This is because it sets criteria for interpretation, independent reasoning, and derivation
People fall into three categories in relation to the jurisprudence of the balance: First, people with a pure innate disposition. These include scholars who pursue wisdom and deeds of goodness. They tend to judge people by their honesty.
